Terms of Service

1. Acceptance
By creating an account or using SimCockpit (“the Service”), you agree to these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
SimCockpit is a digital telemetry platform that streams data from PC truck simulators (ATS and ETS2) to Android devices. It is an independent hobby project and is not affiliated with SCS Software s.r.o. or any other simulator developer.
3. Eligibility
You must be at least 16 years old to use the Service. By registering you confirm that you meet this requirement.
4. Subscriptions and Payments
Paid plans are billed monthly via Stripe. Prices are shown in euros (€) and include applicable taxes where required. Subscriptions automatically renew at the end of each billing period unless cancelled beforehand via the billing portal (Dashboard → Billing → Manage billing).
4.1 Merchant of Record. For customers located in the European Economic Area (EEA), the United Kingdom, and Switzerland, the seller of record is Simcockpit.app, Dielmannstr. 13, 63069 Offenbach am Main, Germany, and Stripe Payments Europe, Ltd. acts as the payment processor. For customers located elsewhere, payments are processed through Stripe Managed Payments, with Stripe Payments Company acting as Merchant of Record. In that capacity Stripe is responsible for collecting and remitting applicable sales tax, VAT, GST, or other local consumption taxes in your jurisdiction. Your contract for the use of SimCockpit remains with Simcockpit.app in either case; only the payment counterparty on your statement differs.
4.2 Digital service — right of withdrawal. SimCockpit is a digital service delivered immediately upon subscription. By checking the withdrawal waiver on the pricing page and completing checkout, you expressly request immediate access and acknowledge that your 14-day statutory right of withdrawal under § 356 (5) BGB / Art. 16(m) of the Consumer Rights Directive lapses upon commencement of the service. 5. Free Plan Limitations
The Free plan is limited to 1 paired device and the 8 baseline cab gauges (Speedometer, Tachometer, Fuel Gauge, AdBlue, Gear, Retarder, Compass, Odometer). All other widgets and the premium widget packs require a Start or Pro subscription. We reserve the right to adjust free-plan limits with 30 days' notice.
6. Acceptable Use
You agree not to:
- Reverse-engineer, decompile, or attempt to extract source code from the Service.
- Use the Service for any unlawful purpose.
- Share account credentials with third parties.
- Attempt to circumvent plan limits or access restrictions.
- Introduce malicious code, spam, or overload our infrastructure.
7. Intellectual Property
All content, code, and branding of SimCockpit belong to the operator. Simulator game data belongs to their respective publishers. “Euro Truck Simulator 2” and “American Truck Simulator” are trademarks of SCS Software s.r.o. SimCockpit is not endorsed by or affiliated with SCS Software.
8. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, uninterrupted availability, or error-free operation.
9. Limitation of Liability
To the maximum extent permitted by law, the operator shall not be liable for any indirect, incidental, special, or consequential damages arising from use of or inability to use the Service. Total liability shall not exceed the amount you paid in the 3 months prior to the claim.
10. Termination
We may suspend or terminate accounts that violate these Terms. You may delete your account at any time via Dashboard → Settings → Delete Account. Deletion removes your personal data subject to legal retention requirements.
11. Changes to Terms
Material changes will be communicated by email at least 14 days before taking effect. Continued use after the effective date constitutes acceptance of the revised Terms.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on the International Sale of Goods. For consumers in the EU, mandatory consumer protection provisions of your country of residence also apply. The EU Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr. We are not obliged to participate in alternative dispute resolution.
